DESIRE Dating UK SERVICE AGREEMENT
By completing the signup page and using the Desire Dating service you indicate your acceptance of this Agreement and its terms and conditions. If you do not accept this Agreement, do not use the Desire Dating service.
This Service Membership Agreement (the "Agreement") is made by and between NSI (Holdings) Ltd, a UK registered company Registration number 5236118 and registered for VAT No.855 9741 75 and you, as user of the Desire Dating service.
Eligibility
You must be eighteen or over to register as a member of http://www.desire-dating.co.uk or use the Website. Membership of the Service is invalid where it has been prohibited. By using the Website, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.
CHANGES TO THE SERVICE
Desire Dating reserves the right to change, modify, add or remove portions of this Agreement at any time and may add to, change, suspend or discontinue any aspect of the Service at any time. In either such case Desire Dating UK will notify Members via e-mail, newsletter or the Desire Dating Website of such changes, at which time Members may either agree to such changes or withdraw from the Service.
REGISTRATION AND SUBSCRIPTION
You may become a member of the Service at no cost. As a member you will have the ability to participate in some, but not all, of the features and services available within the Service. In order to access additional features and services, including the ability to communicate with other members, you must become a paying subscriber to the Service. Please see our billing details for a description of the current continuous service rates. This rate list is part of this Agreement. We can change the subscription fees for the Service at any time without further notice to you. RECURRING BILLING
By entering into this agreement you agree that subscription payments to the Service consist of an initial period, for which there is a one time charge, followed by recurring periodic charges which you choose, excluding desire-dating.co.uk “TEXT PAY� service. All recurring charges shall remain active unless you cancel your subscription on or before its renewal date.
You agree that desire-dating.co.uk will continue to bill you until you cancel your authority for desire-dating.co.uk to bill your recurring account. Desire Dating may submit periodic charges monthly without further authorisation from you, until you provide written notice that you have terminated the authorisation or wish to change your payment method. No pro-rata refunds will be issued to you if you should choose to cancel your subscription but full membership benefits will still be available until your current subscription expires. Such notice will not affect charges submitted before Desire Dating could reasonably act. To terminate or change your payment method, go to http://desire-dating.co.uk login and go to “My Profile� and select “My Account� where you will find the options to change or cancel your authority for Desire Dating to continue with recurring billing.
ACCEPTED USE OF THE SERVICE
You shall not provide, promote, distribute, place or otherwise publish as a Member of the service any content, or profile that includes content, which is libellous, defamatory, abusive, and fraudulent or violates any law. As Desire Dating may not review all information provided by you, you shall remain solely responsible for your profile content. Desire Dating reserves the right to deem any profile inappropriate and terminate any membership of Desire Dating. If you are terminated from the Service, Desire Dating UK will not refund any unspent subscription for the Service.
ACCOUNT SECURITY
You are responsible for maintaining the confidentiality of the login email and password that you designate during the registration process with the Service, and you are fully responsible for all activities that occur under your login email and password. You agree to (a) immediately notify desire-dating.com of any unauthorised use of your username or password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Desiredating.co.uk will not be liable for any loss or damage arising from your failure to comply with this provision. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. If you share your computer with others, it is best practice to disable “your remember me� feature. You must only subscribe to your RSS FEED on a private computer and for your own security it is not a good practice to subscribe to your RSS FEED on a PUBLIC or SHARED computer.
NON COMMERCIAL USE BY MEMBERS
The Website is for the personal use of individual members only and may not be used in connection with any commercial ventures. Organisations, companies, and/or businesses may not become members and should not use the Service or the Website for any purpose. Illegal and/or unauthorised uses of the Website, including collecting names and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorised framing of or linking to the Website will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.
PROPRIETARY RIGHTS IN CONTENT ON DESIRE-DATING.CO.UK
NSI (Holdings) Ltd owns and retains all proprietary rights in the Website and the Service. The Website contains the copyrighted material, trademarks, and other intellectual property and proprietary information of desire-dating.co.uk, and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, reproduce, license, create derivative works from, transfer display, or sell or re-sell any such intellectual property or proprietary information.
LIMITED WARRANTY
The Service, its use and the results of such use are provided "as is." To the fullest extent permissible pursuant to applicable law, Desire Dating disclaims all warranties expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, in relation to the service, its use and results of such use. Without limiting the foregoing, Desire Dating specifically disclaims any warranty (A) That the service will be uninterrupted or error-free, (B) that defects will be corrected, (C) that there are no viruses or other harmful components, (D) that the security methods employed will be sufficient, or (E) regarding correctness, accuracy, or reliability. Applicable law may not allow the exclusion of implied warranties so the above exclusion may not apply to you.
LIMITATION OF LIABILITY
Desire Dating or its suppliers or resellers shall not be liable to you or any other person for (1) any direct, special, incidental or consequential damages of any character arising out of the use or inability to use the Desire Dating service or any information provided on the Desire Dating website or any other hyper linked web site. Including, without limitation, damages for loss of goodwill, any lost profits, business interruption, loss of programs or other data on your information handling system or otherwise, even if Desire Dating or a Desire Dating authorised representative has been advised of the possibility of such damages or (II) any claim attributable to errors, omissions or other inaccuracies in the web site or any hyper linked web site. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, the above exclusion may not apply to you. In such jurisdictions, Desire Dating liability is limited to the smallest amount permitted by law. This paragraph will survive the failure of any exclusive or limited remedy.
TERM AND TERMINATION
This Agreement shall remain in effect until terminated. Upon termination, you shall no longer be entitled to use the Service. Your account may also be deleted if we are unable to get in touch with you by email. Please ensure that you have a valid email address registered with us at all times. Reasonable efforts will be made on the part of Desire Dating to contact you if Desire Dating have to contact you. If however, you are not reachable, your Membership account will be cancelled and any unspent subscription may not be refunded.
LEGAL TERMS
The Laws of England govern this agreement at all times. All parties are bound to the jurisdiction of the English Courts for the settlement of any disputes or claims that arise from participation in this service or in connection with this agreement.
